Independent authors and other content providers may be subject to a separate Author Publishing Agreement, Commission & Earnings terms, Publishing Guidelines, or other written agreement. Those additional terms are incorporated by reference where applicable.
GiftedPages4U is a digital reading, listening, learning, and media platform that may provide access to ebooks, audiobooks, podcasts, eCourses, original programming, films, short-form video, educational material, promotional material, and other digital content. Content may be created or owned by Bigupstar.com LLC, by independent authors and creators, or by other licensors and rights holders.
Content may be made available through subscriptions, memberships, one-time purchases, promotional access, free access, gift access, trials, or other access models offered from time to time.
These Terms apply to the Services made available by or through GiftedPages4U, including:
You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the permission and supervision of a parent or legal guardian. Certain features, purchases, platforms, or third-party services may impose additional age requirements.
Unless we expressly state otherwise, digital content accessed through GiftedPages4U is provided under a limited license for personal, non-commercial use. Purchasing access to digital content does not transfer copyright or ownership of that content to you.
Subject to these Terms and any applicable purchase or access conditions, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use content made available to your account for its authorized purpose and duration.

We may offer monthly, annual, or other recurring membership or subscription plans. The price, billing period, included benefits, and renewal terms will be disclosed at or before purchase.
A subscription or membership provides access to the content and features included in the applicable plan while those items are available. Unless expressly stated otherwise, membership does not guarantee that any particular title, author, audiobook, eCourse, film, feature, or device integration will remain available indefinitely.
We may add, remove, replace, reorganize, delay, suspend, or modify content or features for licensing, contractual, legal, technical, security, quality, editorial, business, or other operational reasons.
One-time purchases provide access to the specific content and access period described at checkout or on the applicable product page. One-time purchases are associated with the purchasing account and are non-transferable.
Some products may provide time-limited access rather than permanent access. Any stated access period controls.
The payment method and billing provider used may depend on the platform through which you make a purchase.
Purchases, subscriptions, upgrades, downgrades, and other paid transactions initiated within Gifted Pages Stream on Roku are processed through Roku Pay where required by Roku's platform rules. Roku is responsible for processing those Roku Pay transactions under Roku's applicable terms and privacy practices. GiftedPages4U may receive transaction, product, entitlement, subscription-status, cancellation, and other limited billing information needed to provide and administer the purchased access.
Purchases made directly through giftedpages4u.com may be processed by third-party payment providers such as Stripe. Those providers may collect, process, and store payment information according to their own terms and privacy practices. GiftedPages4U does not intentionally store complete payment-card numbers on its own application servers.
Purchases or subscriptions made through a third-party platform may also be subject to that platform's billing, cancellation, refund, and account rules. You are responsible for any applicable taxes, fees, or other charges disclosed in connection with a purchase, except where the law requires otherwise.
Refund eligibility is governed by our separate Refund Policy and applicable law. Because digital products may be made available immediately after purchase, some purchases may become non-refundable once access is granted, except where our Refund Policy or applicable law provides otherwise.
We may review requests involving duplicate charges, billing errors, failed access, unauthorized transactions, or other circumstances described in the Refund Policy.

GiftedPages4U may make some Services or content available through Gifted Pages Stream on Roku, GiftedPages4U experiences on Alexa-enabled devices, connected televisions, voice assistants, streaming devices, mobile devices, browsers, or other supported platforms. Device availability, catalog availability, playback options, account features, and functionality may differ between platforms.
Your use of a third-party device, operating system, app store, voice assistant, or platform may also be subject to that third party's own terms, privacy policies, account rules, billing requirements, availability requirements, and technical limitations. Purchases made through Roku are also subject to applicable Roku Pay and Roku account terms.
We do not guarantee that every GiftedPages4U title or feature will be available on every supported device. We may add or discontinue a device integration or platform feature at any time, subject to applicable law.
Where supported, GiftedPages4U may save listening, reading, viewing, watch, or course progress and make that information available on other compatible devices associated with your account.
Synchronization depends on internet connectivity, compatible software, account status, third-party platform functionality, and other technical factors. We do not guarantee that synchronization will always be immediate, exact, uninterrupted, or available on every platform.
GiftedPages4U may host, distribute, promote, stream, display, or otherwise make available books, audiobooks, courses, films, media, and other works submitted by independent authors, publishers, creators, licensors, or other third parties.
The presence of a work on GiftedPages4U does not mean that Bigupstar.com LLC owns the copyright in that work. Independent authors and other rights holders retain ownership of their intellectual property except to the extent they expressly transfer rights under a separate written agreement.
Participating authors grant GiftedPages4U the licenses and permissions described in the applicable Author Publishing Agreement or other content agreement. Those permissions may include rights reasonably necessary to host, reproduce for technical delivery, display, stream, distribute, promote, market, and make approved content available through GiftedPages4U websites, applications, supported connected-TV applications, voice platforms, and other approved distribution channels.
Independent-author participation is governed by separate author-facing terms, including the Author Publishing Agreement, Commission & Earnings information, and Publishing Guidelines.
The author-facing documents may address matters such as content ownership, distribution permissions, pricing, revenue share, the platform commission, payment schedules, taxes, refunds, chargebacks, reserves, content removal, marketing permissions, reporting, warranties, and termination.
If there is a conflict between these general Terms and an applicable Author Publishing Agreement concerning an author's submitted content, compensation, ownership, or distribution rights, the Author Publishing Agreement controls for those author-specific matters.

Any author, creator, publisher, or other person submitting content to GiftedPages4U represents and warrants, as further described in the applicable author or content agreement, that they possess the rights necessary to submit and authorize use of the content and that the content does not unlawfully infringe the rights of others.
We may request supporting information or documentation before or after publication and may reject, restrict, suspend, unpublish, or remove content where we reasonably believe there may be a rights, legal, safety, technical, quality, contractual, policy, or fraud concern.
We are not obligated to accept or continue distributing every submitted work. We may review content for technical compatibility, quality, metadata, rights concerns, legal compliance, security, platform suitability, or compliance with our Publishing Guidelines.
Nothing in these Terms requires GiftedPages4U to publish, promote, feature, recommend, or continue carrying any particular work, except to the extent a separate written agreement expressly states otherwise.
We respect intellectual property rights. If you believe content available through the Services infringes your copyright or other intellectual property rights, please follow our Copyright / DMCA Policy.
We may remove or disable access to material when appropriate and may take action against accounts or content providers that repeatedly or materially violate intellectual-property rights or our policies.

The Services may depend on or link to third-party services, payment processors, authentication providers, hosting services, social-media platforms, app stores, device manufacturers, voice platforms, or other external services. We do not control those third parties and are not responsible for their independent services, policies, outages, changes, security practices, or content.

By providing contact information and using the Services, you agree that we may send transactional, account-related, security, purchase, service, and legally required communications. Marketing communications, where used, are subject to applicable consent and opt-out requirements.

Author-specific indemnification, warranties, and rights obligations may also be addressed in the applicable Author Publishing Agreement.
These Terms are intended to operate subject to applicable federal, state, local, and other laws and regulations. Nothing in these Terms waives rights or remedies that cannot legally be waived.
If a provision is found unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
These Terms, together with the Privacy Policy, Refund Policy, applicable purchase terms, and any additional agreements that apply to a particular service or program, form the agreement governing your use of the Services.
For independent authors and content partners, the applicable Author Publishing Agreement, Commission & Earnings terms, Publishing Guidelines, and any signed or accepted supplemental terms also apply.
